    The Arbitration Specialist provides excellent customer service to internal and external customers while handling arbitration claims. Develops resolution plans to recover payments where subrogation/arbitration potential have been identified. Reviews, analyzes and responds to arbitration files. Must be proficient at understanding coverage, interpreting policy language and recognizing potential exposures.

    Responsibilities

    Job Responsibilities:

    • Responsible for preparing a complete arbitration filing that effectively present a theory of liability, to include a written persuasive argument and supporting physical evidence.
    • Thoroughly reviews all claims files to determine appropriate liability strategy. Reviews coverages and alerts to determine if an affirmative pleading or defense is applicable.
    • Requests and prepares necessary investigative documentation to support liability (police reports, scene photos/diagrams, vehicle photo, estimates and recorded statements)
    • Researches specific states laws and statutes that may support liability argument or rights to subrogate.
    • Negotiates and discusses liability with the Claim Branch Representatives to support a proper defense. Provides feedback to all branch offices regarding the quality of claims handling.
    • Assists internal and external customers with the resolution of arbitration related questions and customer complaints.
    • Participates in liability roundtables to provide teammates with feedback and recommendations for file resolution.
    • Appeals clerical or jurisdictional arbitration decision errors when applicable.
    • Serves monthly as an Arbitration Forum Panelist.
    • Handles all, Auto, Special, Property, PIP/MP and UM, arbitration files as Applicant and Respondent within the Department of Insurance Regulations for the specified state and the Esurance Subrogation Handling Guidelines.
    • Manages MCCA data spreadsheets, MCCA submission and resubmissions; reconciles wire notices and searches payment transactions for appropriate quarter submissions.
    • Research MCCA denials through the MMS system.
    • Attends quarterly meetings with Actuarial providing current status of MCCA files
    • Acts as a liaison between departments to ensure Subrogation and MCCA is represented when working with the PIP
    • Adheres to Fair Claims Practices Acts, Fair Debt Collections Act, Fair Credit Reporting Act, and all local laws and ordinances

    Qualifications

    - Detail-oriented with strong organizational skills, able to work well under deadlines in a changing environment and perform multiple tasks effectively and concurrently.

    - Demonstrated ability to manage relationships with both internal and external customers.

    - Demonstrated ability to work independently and within a collaborative team oriented environment using sound judgment in decision-making.

    - Excellent communication skills both oral and written with strong analytical and basic math skills.

    - Excellent customer service and solid negotiation skills.

    - Demonstrated proficiency with Microsoft Office products (Outlook, Excel, Access, and Word) and claims related software programs preferred.

    - Demonstrated knowledge of arbitration, claims and subrogation claims

     

    Experience / Education:

    - Bachelors degree or equivalent education and/or equivalent work experience required.

    - Three or more years of arbitration, subrogation and/or claims experience preferred.
